Zmode Terms of Service
Effective date: October 25, 2026
1. Agreement#
These terms are an agreement between you and Zmode, Inc. ("Zmode"). By creating an account or using Zmode, you agree to them. If you use Zmode for a business, you confirm you can accept these terms for it.
2. What Zmode does#
Zmode helps businesses run their website, bookings, customer messages, payments and marketing, with an AI assistant that acts on the business's instructions. Features may change as we improve the product.
3. Your account#
You must be at least 18 and give accurate information. Keep your sign-in secure; you're responsible for activity on your account. Tell us at support@zmode.com if you think it's been accessed without permission.
4. Your content and your customers#
- You own your content and your customer data. You give Zmode permission to host, process and display it only to provide and improve the service.
- You're responsible for having the right to use the content and customer data you add, and for getting your customers' consent where the law requires it, including consent to receive texts, calls and emails.
- Zmode processes your customers' data on your behalf, as described in our Privacy Policy.
5. AI features#
Zmode's AI writes replies, builds pages and carries out tasks from your business's data and your instructions. AI can make mistakes. Review what it prepares, especially prices, policies and anything legal or medical. Actions that send, charge or delete ask for your confirmation unless you turn them on to run by themselves, and you're responsible for actions you approve or turn on. You can pause the AI at any time.
6. Connected services#
When you connect WhatsApp, Instagram, Facebook, Google, LinkedIn, TikTok, Stripe or other services, you also follow those services' own terms. Zmode isn't responsible for their availability or changes. You can disconnect them at any time.
7. Acceptable use#
Don't use Zmode to send spam or unsolicited messages, break the law, infringe others' rights, mislead people, collect data without permission, or harm Zmode or its users. We may suspend accounts that do.
8. Plans, payment and cancellation#
Paid plans are billed in advance through Stripe, at the price shown when you subscribe, and renew until you cancel. You can cancel any time in the app; access continues to the end of the paid period. Fees aren't refundable except where the law requires. We'll give at least 30 days' notice before a price change takes effect.
9. Domains#
If you buy a domain through Zmode, it's registered for your business and you can ask to transfer it to you, subject to the registrar's rules (for example, a transfer lock after purchase).
10. Ending your account#
You can delete your account at any time. We may suspend or end it if you break these terms or don't pay. On request before deletion, we'll give you an export of your data. After deletion, we delete your data as described in the Privacy Policy.
11. Disclaimers#
Zmode is provided "as is". We work hard to keep it running and accurate, but we don't promise it will be uninterrupted or error free, or that it will bring a particular result for your business.
12. Limitation of liability#
To the extent the law allows, Zmode isn't liable for indirect or lost-profit damages, and our total liability for any claim is limited to what you paid Zmode in the 12 months before the claim.
13. Indemnity#
You'll cover Zmode's reasonable costs from claims caused by your content, your messages to customers, or your breach of these terms.
14. Changes to these terms#
We'll post changes here with a new effective date, and tell you by email or in the app at least 30 days before a material change takes effect.
15. Law and disputes#
These terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. Disputes are resolved in the state or federal courts there, unless the law where you live gives you other rights.
